Information about processing of personal data
Flexio Staffing Group AB, (org. nr. 559203-2618 Nordenskiöldsgatan 24, 211 19 Malmö) and the subsidiaries Flexio Staffing AB, (org. nr. 559074-8934), Flexio Service AB (559363-9627) and Flexio Work AB (org. nr. 559215-2481) hereinafter referred to as Flexio make it possible for legal entities (“clients”) to find and hire people (“contractor”) for different types of hour-based assignments. To do this, we need to collect and process some personal data.
This policy for personal data explains how we collect and process your personal data when you use our service (“The service”), at flexio.com or on the mobile application Flexio. It also explains your rights towards us and how you can assert your rights.
By using The service, you accept this personal data policy and that your personal data will be collected and processed in the way described here. It is important that you read and understand this policy before using The service.
This policy may at times have to be changed or updated, for example if any functions change or are added to the service. You will in that case be informed by this in the service, or another appropriate way, to make it possible for you to take a stand to the change before it is being applied.

How Flexio process your personal information
At Flexio, we respect your privacy and want you to feel safe with how your personal information is being processed. Below you will find information about what records of you that Flexio will process, for what purpose, the legal basis for processing, and how long the records will be saved along with your rights.
Controller/Data controller

Flexio Staffing Group AB (org. nr. 559203-2618, Nordenskiöldsgatan 24, 211 19 Malmö) and the subsidiaries Flexio Staffing AB (org. nr.559074-8934), Flexio Service AB (559363-9627) and Flexio Work AB (org. nr 559215-2481) is in accordance with these policy controllers for the process of your personal data in the service.
Flexio has appointed a data controller that will monitor that the business follows the rules of data protection.

Who’s information do we process?
Flexio processes personal data for different stakeholders. The following stakeholders are affected by us:
Contractors/candidates - Personsthat we are in contact with regarding jobs with us or our clients. The persons included in this group are the ones who have actively applied for a job, the ones who have registered in our app without applying for a job, the ones who have visited our webpage and looked at content, and potential clients we have found by reaching out to them in different ways.
Employee - persons who are employed or have been employed in our business.
Contractors - contact person at companies that we buy services and products from.
Clients - contact person at companies that buy our services.
Potential clients - contact person at companies that we process for marketing purposes.
Other stakeholders - persons who are not included in any of the above categories but whom we are in contact with for different reasons. These can be references for a candidate, emergency contact for an employee (close relative) or persons that we are in contact with in different forums such as sales representatives from other companies where we are not clients, persons in professional networks, media contacts and so on.
How do we use & protect your personal information?
Your personal information is primarily used to provide, use and improve The service. Your personal information is also used to confirm your identity when you log in to The service, and device information to ensure that The service is being presented in the best way for you and your device.
Flexio collects different types of information about you when you are using The service, partly depending on what group of stakeholders you belong to, we process different types of personal information during various amounts of time and for different reasons. See the description below how we process these:
Contractors/candidates
1. What are we using your personal information for?
To evaluate you as a contractor. If you apply to become a contractor, your account information and information about your qualifications will be used to evaluate your suitability as a worker. To be able to perform assignments as a worker you must be 18 years of age and have the right to work in Sweden.
To process your application to an available gig (job) which means we might evaluate your competencies - both professional, aptitude and personality.
Offer/match you with gigs (jobs) related to your wishes and/or your competencies plus provide you with personal offers, information or invitations that we find interesting for you via our app, email, digital and/or social media.
Continuous communication regarding the jobs you have applied for via Flexio.
Other statistical purposes, i.e. maintain and develop the quality of our services.
2.What personal information might we collect?
Name
Email-address
Mobile Phone number
Competencies and earlier experiences collected through your profile in our app, your LinkedIn- or Facebook profile (if you registered your application via any of these channels), through interview and based on the knowledge and experience you register on your account.
Test results, if you have performed tests as a part of our unprejudiced recruitment process.
Photography, if you have included one in your profile
Video, if you have included one in your profile
Your Social security number (or samordningsnummer) and your ID- or passport information will be used to confirm your identity. This action is also required to determine if you should be able to perform assignments through The service.
If you activate the function “Location services” on your phone, the information about your current geographic location will be collected.
In some cases, during the qualification process, we might collect an open so called background check about you. This contains information about income, matters with the Swedish Tax agency (Skatteverket) and the enforcement authority (Kronofogdemyndigheten), your marital status, drivers licence, matters with the court and any eventual judgements. Please note that none of the above information will be saved in our system.
Communication through the chat function with clients or Flexio support. You decide what information you want to share in your messages. Do not include sensitive information or any other personal information.
Information regarding your performance on assignments such as reviews and grades
Any other personal information that you choose to share in your profile and any uploaded or sent documents.

* We advise you not to share sensitive personal information regarding ethnic background; political opinions; religious or philosophical belief; membership in any union along with information about health. We therefore reserve the right to, without your consent, erase all of the above information, along with personal information regarding others other than yourself. 
3.How have we collected your contact information?
We have gotten the information from you through the information you have registered in our application.
We have collected the information automatically when you have visited our app to apply for jobs, worked or chatted with us.
We have collected the information when you have emailed, called us regarding something or left contact information in for example a survey that we have implemented where you wanted to get in touch with us.
4.With whom do we share the information?
We work with recruitment and staffing which means we share your information with our Clients when assigning jobs.
We share your personal information with third party suppliers that we hire to perform services on our behalf (such as technical, administrative, market related or other services) when necessary for the purposes mentioned above. These third party suppliers are not allowed to use your personal information for their own purposes which we have regulated in agreement with these suppliers.
your personal information may be handed out if necessary by law such as for example the legislation of discrimnation or Data protection authorities.
5.What rights do you have?
Erasement of personal data
If you have registered your profile in our app you can end your membership at any time by contacting us and demanding that we erase your profile and personal information that we have collected about you. When your profile is deleted it will disappear completely alongside with all the information we have about you in our system.
Please observe
There is an exception to complete erasement; if you have applied for a job through us, we need to save your application information for 24 months after the recruitment process is over in reference to the legislation of discimination. If we erase your profile within the 24 months, after the recruitment process, your information will be anonymised and hidden and can only be obtained by a data protection agent at Flexio. When 24 months have passed your information will be deleted automatically.
The right to object
You have the right to object that we use your personal information, for example, in your profile, you can go to “matching criteria”and choose to remove your availability if you do not want a notification about a match from us. You can also contact us and we will help you. 
Correction of personal information
You have the right to demand that we correct or erase information that is inaccurate or incomplete. You can easily do this yourself by logging into the app and correct and erase your own information.
Access to your personal information - register extract
You have the right to get access to the categories of personal information that we process about you, via a register extract. A register extract is free of charge one time per year. If you want several register extracts during one year, we charge an administration fee of 395 SEK per time.
6.For how long do we keep the information?
You own the information that is registered on your profile and can choose to erase parts of the information or your whole account.
If you as a member have not logged in or been active on your account during a period of two (2) years, your whole account will be erased. We will remind you shortly before these two (2) years have passed for you to get a chance to update your account in case you wish to still remain a member in our network.
If you contact us and wish for your information to be erased we will do that unless we are bound by law to keep the information. See exceptions described in the section five above.
We reserve the right to erase user accounts if we see that the account is misused in any way. It can be that the account is created for other purposes than to apply for jobs and to be a part of our network, or if the registered in any way made threats towards our staff or in other ways behaved improperly.
Employee
1. What are we using your personal information for?
When you become an employee of Flexio you enter an agreement with us as employers. In this relationship it is required of us as employers to process a larger amount of personal data to follow a great number of legislation that employers in Sweden are required to follow. Examples of these can be work environment legislation, discrimination legislation, legislation of sick pay, holiday legislation etc.

3.How have we collected your contact information?
You have stated these yourself in the recruitment process and in connection when your employment started.
The information has been generated in accordance with your employment
The information has come from other sources such as agencies, third party suppliers that perform services for us and from references and clients.
4.With whom do we share the information?
If you are an employee we share some personal data to our clients for them to be able to assign you access in the clients IT-system, get access to the clients premises, for the client to be able to perform any security controls on you and anything else that might come with the assignment. The client in turn shares information to us regarding your performance on the assignment you work on.
Are you an employee at any of our regional offices, your contact details may be shared with consults, clients, assignment candidates, suppliers and other stakeholders which have to do with the service you have at Flexio.
We share your personal data with third party suppliers that we hire to perform services on our behalf (such as technical, market related or other services) when necessary for the purposes of handling your employment. These third parties are not to use your personal information for other purposes that we have regulated in agreement with these suppliers.
Your personal information might be handed out if necessary by law.
5. What rights do you have?
Correction and erasement of personal information
You have the right to demand that we correct or erase your personal information that is inaccurate or incomplete. It can even be seen as an obligation to inform us if your information is inaccurate since we might get trouble with the payment of your salary, get in touch with you regarding your employment or similar. However, you do not have the right to get erased during the course of the employment and not within the next seven (7) years of your termination of employment. This with reference to Swedish legislation (The accounting act, preferential rights according to The Swedish Labour Law (LAS) etc.)

You have the right to get access to the categories of personal information that we process about you - via a register extract. A register extract is free of charge one time per year. If you want several register extracts during one year, we charge an administration fee of 395 SEK per time.
6.For how long do we keep the information?
As long as you are an employee for us we will process your personal information. When your employment terminates a large amount of your personal data will be deleted automatically. However, we will have to save some information for a longer period of time according to Swedish legislation. Your information will be saved for a maximum of seven (7) years after terminated employment.
Contractors
1.What are we using your personal information for?
The personal information that we process regarding our contractors is the ones we need to maintain our professional relationship. It can be personal information regarding the client responsible, support, service staff, economy department or other key persons.

5.What rights do you have?

6.For how long do we keep the information?
For as long as you are an important person for us in our professional relationship, we will save your information. If it comes to our knowledge that your tasks at your company have been changed or that you have changed employers, the information will be deleted.
Clients and potential clients
1.What are we using your personal information for?
Client: If you are an employee at one of our clients, as a coordinator/buyer or a contact person, responsible for e.g. a logistics department, we process some personal information to maintain our professional relationship, and to live up to Swedish legislation, i.e. The accounting act and The tax legislation.
Potential clients: To be able to provide our services to companies that do not know about us, we collect contact information to key persons at companies that we want to contact and process for marketing purposes.

Communication in The service through the chat with employees or Flexio support. You decide what information you want to share in your messages. Do not include sensitive information or any other personal information.
Notes regarding our cooperation and/or dialogues
Information about assignments such as work descriptions, time and place for the assignment along with reviews and grades.
Please note that the above list is not exhaustive and that other information might be processed.
3.How have we collected your contact information?

We have received them from you by visiting our website, registering for any of our events, and showing interest in being contacted or subscribing to our newsletter.
We have searched for the information on the Internet. It can be from the company’s website or sites such as LinkedIn

4. With whom do we share the information?
Your personal information is used within our organization for us to be able to uphold or to open up for future professional relationships. We share your personal information with third party suppliers that we hire to perform services on our behalf (such as technical, market related or other services) when necessary for the purposes of handling our cooperation or for us to be able to process you as a potential client. These third parties are not to use your personal information for their own purposes that we have regulated in agreement with these suppliers.
5.What rights do you have?
Correction and erasement of personal information
Client: You have the right to demand that we correct or erase information that is inaccurate or incomplete. If you have changed your employment at the company or you no longer work there and we have gotten a new contact person, we appreciate it if that information will be given to us.
As a client contact we cannot erase your personal information completely given your information might have to be saved for invoice documentation and accounting.
Potential client: If you do not want to be a part of our CRM-system as a potential client, you can either notify us or unsubscribe from mailing lists and further contact. In order for us to avoid contacting you after you have unsubscribed, we still need to save either your name or email address in a so-called block list. If you ask to be completely removed, there is a high risk of us finding your contact information again and reaching out to you.
Access to your personal information - register extract
You have the right to get access to the categories of personal information that we process about you - via a register extract. A register extract is free of charge one time per year. If you want several register extracts during one year, we charge an administration fee of 395 SEK per time.
6.For how long do we keep the information?
Client: If you, as a representative of a company have ordered a service from us and your name has been the reference used for the assignment, we will save your personal information for seven (7) years in order to live up to The Accounting act.
Client and potential clients: We will continuously update our CRM-database. This means that we continuously work to have an updated and accurate database with up-to-date and correct contact information. This will take place by contacting you via phone, email, social media and in personal meetings, but also through external monitoring.
Other stakeholders
1.What are we using your personal information for?
All individuals that do not belong to the other categories fall under the category Other stakeholders. This group can include references in a recruitment procedure, a contact in a professional network, colleagues in the industry or sales persons from other companies etc. Therefore it is hard to describe and cover exactly what we use the information for in each case. However, we make an attempt below with example groups that probably is not completely covered.
References in a recruitment procedure
When a candidate is of interest for a service, we will contact persons that could give information about how the candidate has performed and acted on other work sites. In order for us to contact the reference, we need a name and phone number. In most cases we also need to know what the person’s position is and what relationship they have had with the candidate (i.e. boss).
Emergency contact/next of kin to the employee
When we hire someone we ask for a so-called emergency contact, a close relative to the employee that we can contact if anything were to happen during working hours or commitments/travels within the job.
Persons who contact us on social media, through our telephone support, website (including chat) and via email.
If you as an individual have contacted us regarding a question, or any other matter, we may save your personal information for us to be able to contact you in the future.
Partners, colleagues in the industry, sales representatives and key persons at other companies, persons in professional networks, media contacts or similar.
We may save your contact information for future communications. We as a company need to save this information in order to effectively operate on the market and create relations that promote ours and other companies growth.

We have received this when you have shown interest in being contacted or have contacted us through phone, social media, website (including chat), info-email or personal inboxes.
We have the information in our own individual networks, for example on LinkedIn.
4.With whom do we share the information?
We differentiate persons who are in contact with us as a private person and persons who are in contact with us on behalf of a company. We are more restrictive with personal information in the first case and generally do not share this data with any external part. When it comes to personal information of professionals, we are not as restrictive since sharing contacts within a professional network promotes business and the growth of the companies. We do not consider personal information where you represent a company to be as sensitive regarding privacy either as compared to personal information regarding private persons.
We use third party suppliers that we hire to perform services on our behalf (such as technical, administrative, market related or other services) when necessary for the purposes of handling contacts with other stakeholders. These third parties are not to use your personal information for their own purposes which we have regulated in agreement with these suppliers.
5.What rights do you have?

You can contact us and demand that your personal information is corrected or erased. If we do not have any purpose in keeping your personal information, we will erase it. In some cases we may keep the information despite your demand. This could be if you for example have been a reference related to an appointment position. We will in that case do it on a legal basis with legitimate interest.

You have the right to get access to the categories of personal information that we process about you - via a register extract. A register extract is free of charge one time per year. If you want several register extracts during one year, we charge an administration fee of 395 SEK per time.
6.For how long do we keep the information?
References in a recruitment procedure
The references contact information will be saved only on the candidate that got the job. We save the data along with a reference protocol, and the candidates other documents for 24 months due to the discrimination legislations regulations about the appeal of appointed positions.
Emergency contacts/closest of kin to the employee
Will be saved for as long as someone is hired. The employee is responsible for making sure the information is correct and up to date.
Persons who contact us on social media, through our telephone switchboard, website, chat and via email.
Will be saved for as long as the information is needed to enable and maintain the communication.
Partners,colleagues in our industries, salespersons and key persons at other companies, persons in professional networks, media contacts or similar.
The information will be saved for as long as it can be seen to fulfill a purpose.
Legal basis
In order for us as a company to be able to save several individuals' personal data, we must have a legal basis for this. If we do not have a legal basis, we cannot process your personal data. There are six legal bases under the GDPR and there are four that are relevant to us:
Consent - You as a person have given us your express permission to process your personal data for certain purposes which you have gotten clear information about. This should preferably be in writing. You can at any time withdraw your consent and we must then stop with that specific action.
Agreement - You have entered an agreement with us. We can process your personal information in order to fulfill the terms of our agreement.
Legal obligation - We as a company need to process your personal data in order to follow other legislation.
Legitimate interest - Our interest to process your personal data outweighs your interest and the risk of violating your personal privacy is very small.
On what legal basis do we base our processing of your personal data on?
Clients
As a member in our app and network, our process is based on legal basis Agreements
Employees
As an employee, you have a written employment contract between us, legal basis Agreement. Later, when you have finished your employment we need to, according to Swedish law, process parts of your personal data for another seven (7) years. Our process is then under legal basis Legal obligation.
Contractors and clients
In cases where you purchase a product or a service, you enter a contractual relationship, that is why we can base the process between us and other parties on a legal basis - Agreement. If the agreement expires for a client we, according to Swedish law, need to process certain information regarding the buying part for another seven (7) years after the service has been done under legal basis - Legal obligation.
Potential clients
When we market our services to other companies and process personal information to hire with these companies we lean on Legitimate interest as a legal basis.
Other stakeholders
The legal basis for the process of personal data regarding this group can vary depending on what purpose we have for contacting them. In most cases we will initially use Legitimate interest as a legal basis. If we notice that the individual whose personal data we process ends up within any of the other groups of stakeholders, the legal basis that is applicable for that group will apply.
Your data can be processed outside of EU/EES
Flexio always strives to process your personal data within the EU/EES. Your personal data will however in some cases need to be transferred to companies outside of the EU/EES. For example, your personal data will be transferred to Stripe and Google, who will amongst others process your data in the United States of America.

You should note that other rules may apply for your personal data outside of the EU/EES, that sometimes means worse protection. Flexio will however make sure that all reasonable legal, technical and organisational measures are in place to ensure that your personal data is being processed safely and with an adequate level of protection (i.e. Privacy Shield).

About cookies
Personal data may be collected when you are using our website and our app and the information about your usage and what pages you have visited will then be stored. It can be technical information about your device and internet connection such as operating system, browser version, IP address, cookies and unique identifiers. When visiting our website, different techniques might be used to recognize you and learn more about you to be able to offer a better and more personalised user experience. This can happen straight through us or by technology from a third party. This could be usage of for example cookies.
What is a cookie?
There are two types of cookies. The first one saves a text file for a longer period of time, but has an expiration date. This cookie has the purpose of for example telling you what is new since your last visit. The other type of cookie is a so-called session cookie, that lacks an expiration date.The text file is saved temporarily for as long as you are on a site and are surfing on it. It helps with for example keeping track of what language you want to use. As soon as the browser is shut down, the text file is erased.
Why do we use cookies?
At flexio.com we use cookies to for example keep track of and receive webb statistics. We need this statistic to further develop the website to create a better user experience. The information is not available for other parties than Flexio.
To be able to use our websites fully you need to accept cookies, and you do that through your browsers settings or down in the footer on your computer or cell phone. If you do not wish to accept the cookies you can turn off cookies via your browsers safety settings. However, this means that the website will not work as intended.
